1. Agreement to Terms
By accessing or using the PulseVoice AI platform (the "Service") operated by PulseVoice AI, Inc. ("we," "us," or "our"), a product of Astitva Techlabs Private Limited, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
PulseVoice AI is a voice AI platform that enables businesses to create and deploy automated voice agents for outbound and inbound phone calls. The Service includes:
- Voice agent creation and configuration tools
- API endpoints for triggering automated calls
- Call recording, transcription, and analytics
- Webhook integrations for real-time events
- Dashboard for managing agents and monitoring calls
3. Account Registration
To use certain features of the Service, you must register for an account. When registering, you agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update any information to keep it accurate
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4. Acceptable Use
You agree to use the Service only for lawful purposes. You shall not:
- Make calls to numbers on do-not-call registries without consent
- Engage in harassment, threats, or abusive behavior via calls
- Impersonate other individuals or organizations
- Use the Service for fraudulent or deceptive purposes
- Violate any applicable telemarketing laws or regulations
- Transmit malware or attempt to breach our systems
- Resell or redistribute the Service without authorization
- Use the Service for emergency services or life-threatening situations
- Make calls that violate TCPA, GDPR, or other applicable regulations
5. Telephony Compliance
You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations, including but not limited to:
- TCPA: Telephone Consumer Protection Act (United States)
- TRAI: Telecom Regulatory Authority of India regulations
- GDPR: General Data Protection Regulation (European Union)
- Do-Not-Call: National and regional do-not-call lists
- Consent: Obtaining proper consent before making calls
We reserve the right to suspend or terminate accounts that violate telephony regulations or generate excessive complaints.
6. Pricing and Payment
6.1 Credits and Billing
The Service operates on a credit-based system. Credits are consumed based on call duration. Pricing details are available on our website and may be updated with reasonable notice.
6.2 Subscriptions
Subscription plans are billed in advance on a monthly or annual basis. Subscriptions automatically renew unless cancelled before the renewal date. No refunds are provided for partial subscription periods.
6.3 Taxes
All fees are exclusive of taxes. You are responsible for paying all applicable taxes, including GST, VAT, or other transaction taxes.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by PulseVoice AI, Inc. and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you create using the Service, including agent configurations, prompts, and call recordings. You grant us a limited license to use this content solely to provide and improve the Service.
8. Data and Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.
9. API Terms
If you access the Service via our API, you additionally agree to:
- Use API keys only for your authorized applications
- Not share or expose API keys publicly
- Implement reasonable security measures
- Respect rate limits and usage quotas
- Not circumvent any technical limitations
10. Service Level
We strive to maintain high availability but do not guarantee uninterrupted service. Enterprise customers may be eligible for Service Level Agreements (SLAs) with specific uptime commitments and remedies.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSEVOICE AI, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless PulseVoice AI, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
14. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:
- Breach of these Terms
- Violation of applicable laws or regulations
- Fraudulent or abusive behavior
- Non-payment of fees
- Extended period of inactivity
Upon termination, your right to use the Service will immediately cease. You may request export of your data within 30 days of termination.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
